Nicholas Daum has helped obtain successful results in significant, multimillion dollar commercial litigation, representing both plaintiffs and defendants ranging from leading motion picture studios to hedge fund investors and founders of start-up technology firms.

In the area of business litigation, Mr. Daum’s experience includes contractual disputes, intellectual property disputes, accounting fraud, and business torts, including cases under California Business and Professions Code § 17200.

Mr. Daum has participated in matters before numerous federal and state trial and appellate courts at all stages of civil litigation, from briefing and arguing dispositive motions to trial and appeals. An additional practice focus is on offering clients pre-litigation counsel and early-stage strategic analysis of underlying legal concerns.

Copyright Litigation

Currently represents clients in litigation involving the termination of copyright grants by the heirs of the original author and illustrator of Superman.

Film Financing Disputes

Represents major motion picture studio in multimillion dollar litigation concerning a slate-financing arrangement.

Production and Financing Advice

Offered strategic and ongoing advice related to production and financing of motion picture and television shows, including advice related to the production of reality television programs.

Commercial Litigation

Business Torts

Served on a team of three lawyers defending a major casino company against a more than $200 million tortious interference claim in connection with Indian gaming in California. Achieved complete dismissal on summary judgment with no damages awarded.

Represented major hedge fund investors in an action against a Big Three accounting firm related to a collapsed fund. Case resulted in a published opinion from the State of New York Court of Appeals.

Represented a group of founders and early employees of a major internet company in groundbreaking litigation involving the venture capital industry. Case favorably resolved by a confidential settlement.

Pro Bono Litigation

Involved in ongoing major constitutional litigation in California court challenging the constitutionality of the state’s requirement of a two-thirds legislative majority to raise taxes, and to California’s initiative system.
