His experience includes antitrust, advertising, breach-of-contract, securities, and competitor disputes. His clients have included leading media and entertainment companies, manufacturers, and financial institutions.

Mr. Pence appears in both state and federal courts and has also advocated for clients before the Financial Industry Regulatory Authority.

Representative Matters

Media, Entertainment, and Intellectual Property

Represents video game publisher against claims that it induced a competitor’s employees to breach their contractual and fiduciary obligations. Represented firm that licenses patent pools covering essential patents required for use of digital video standards in breach-of-contract action.

False Advertising Litigation

Defended baby product manufacturer against “no injury” product liability/false advertising claims brought as a class action. Represented vacuum manufacturer in competitor dispute involving false advertising claims.

Commercial Litigation

Price Fixing Litigation

Defended Jones Act shipping company and European chemical manufacturer against price-fixing claims in two separate multidistrict proceedings. Conducted internal investigations related to allegations of criminal conduct.

Financial Services Litigation

Defended broker-dealer against fraud and other charges brought by the Financial Industry Regulatory Authority.

Represented real estate investment trust before the California Court of Appeal against intentional interference with prospective economic advantage claim. Defended bank against fraud and unlawful foreclosure claims. Negotiated favorable settlement resulting in dismissal of client from the case. Counseled investment firms and responded to subpoenas issued by government agencies, including the SEC. Provided advice in connection with merger and acquisition activities.

Pro Bono Litigation

Served as counsel-of-record for immigrant clients before the U.S. Court of Appeals for the Ninth Circuit and made oral argument in one of the matters.

Served as counsel-of-record in a landlord-tenant dispute.

Participated in voter protection efforts in California and Nevada.
